Understanding FDA Import Alert 54-07
The FDA import restriction on Germanium products has a history that is frequently misrepresented by importers of foreign material. The facts are straightforward and documented.
The FDA issued the original import alert in 1988 in response to serious safety incidents caused by contaminated or misrepresented Germanium products imported from Asia. A 1995 revision updated the alert language to reflect the passage of the Dietary Supplement Health Education Act (DSHEA) — it did not cancel or weaken the restriction. FDA Compliance Officer Catherine Vieweg of the Dallas International Activities Branch confirmed in writing on May 9, 2005 that the alert remains in effect.
The alert specifically names the forms it covers, including Germanium Sesquioxide and GE-132 — the exact product names under which Designed Nutritional's material is sold. The critical distinction is that this applies to imported material: Designed Nutritional's domestically manufactured product has never been imported and is therefore not subject to the import alert.
For your QA and procurement team: If your current Germanium Sesquioxide supplier sources from outside the United States, ask them to document how their material entered the country in compliance with FDA regulations. If they cannot produce satisfactory documentation, your supply chain carries regulatory risk that Designed Nutritional's domestic material eliminates entirely.
